What are my minerals worth?

Have you received an offer letter to purchase your minerals?  While these transactions appear to be rather straightforward, they can be rather nuanced.

The following questions should be asked when selling your minerals:

  1. Were you aware that you owned the mineral interest that is the subject of the offer letter?  Or is it news to you, albeit good news?
  2. What does the buyer purport that you own?  Legally, we refer to the mineral estate as a “bundle of sticks”.  All this means is that the mineral estate is comprised of several different rights that can be bought and sold separately.  It is very important that you understand what you are being asked to sell.  If not, this could lead to potential future legal issues.
  3. Is the mineral interest currently producing?  Has it previously been under production?  Any potential for near-term future production?  All of these questions are necessary to understand the full value of your mineral rights to be sold.

Answering the above questions along with performing due diligence as to the value of the mineral interest  will ensure that you will receive the highest market price for your mineral estate.
